Remote consultations · Legal procedures in Brazil

A divorce granted in the United States may require additional steps before Brazilian records reflect your new marital status. Meire Sussel Dias provides legal guidance on Brazilian recognition procedures, foreign family judgments and civil registration for Brazilians living abroad.

Does every US divorce need recognition by the STJ?

A simple consensual divorce dealing only with the dissolution of marriage may qualify for direct registration in Brazil. Contested decisions, or those addressing custody, support or property division, require assessment of recognition by Brazil’s Superior Court of Justice (STJ). The content of the judgment determines the appropriate route.

How the service works

  1. Initial contact: tell us where you divorced, your goal in Brazil and the documents available.
  2. Consultation and review: individual assessment of the foreign judgment and Brazilian records.
  3. Fee proposal: scope, engagement terms and expected costs are explained before you proceed.
  4. Documents and proceedings: after engagement, guidance on documentation and the applicable Brazilian procedure.

Documents to prepare for an initial review

Foreign documents may need an apostille or legalization and an official Portuguese translation, subject to applicable treaty exemptions. Have the documents reviewed before ordering additional certificates or translations.

Updating your marital status in Brazil

Start by checking whether and where your marriage appears in Brazilian civil records. A marriage celebrated abroad may involve a separate registration step. Recognition of a foreign judgment and updating civil records should be considered together.

Guidance while living abroad

An initial consultation can be arranged remotely. Useful starting information includes the US state where the divorce took place, the date, whether the judgment addresses children or assets, and the documents currently available. Document requirements and any need for physical originals depend on the individual case.
